Job Description

Head of Legal Fiduciary & LAM Head of Legal Risk Management and Assurance

Responsible for the activities of the Legal Fiduciary area:

  • Attention to the legal consultancy and new trust and mandate agreements generated by Fiduciario and the Business Lines in relation to trusts, management and control of Contractual Risk, Intellectual Property Risk and Breach of Competition Law related to the Trust area. Responsible for the administration of the Legal Fiduciary area as well as the financial and personal resources assigned to it.
  • Work along with the Litigation area, in relation to corporate / legal issues related to litigation cases originated from the Trust Business. Coordination and participation in the executive committees of legal, risk and business.
  • Approval of executive projects, with prior authorization from the LAM General Counsel

Act as the Regional Head of LRMA for LAM as well as regional liaison for special initiatives/projects:

  • Act as primary advisor on the Legal Risk policies, procedures, and other Group Risk Management Framework matters in your area, supporting the LAM General Counsel, as well as all lawyers in the Legal Departments in LAM where needed;
  • act as the main contact in LAM between the regional Operational Risk/Non-Financial Risk teams and the LAM Legal Function and support lawyers in the Legal Departments in LAM on key Operational/non-Financial Risk projects; Assist in LRMA assurance reviews as required and report to the LAM Legal Risk Committee;
  • Act as the secretary of the LAM Legal Risk Committee, preparing and consolidating meeting materials, write meeting minutes, assist the LAM Regional General Counsel in the conduct of the meetings and keeping track of any relevant action points.
  • Act as the central point of coordination for global projects and initiatives that have an impact in multiple LAM countries or Lines of Business, as deemed appropriate by the LAM Regional General Counsel; coordinate first line of defence activities rolled out by the global COO/BRCM teams, including Legal Functional RCAs and control testing activities

Requirements

Major Challenges:

  • Respond to difficult situations with a sense of urgency but within a context that allows analysis, detection, control and timely administration of decision-making in the event of possible contractual, legislative and/or lack of rights risks. contractual, with the purpose of safeguarding the interests of the Bank, maintaining the existing business optimally and seeking opportunities to meet the Trustee’s objectives.
  • Seek improvements in the different processes in which Legal intervenes to optimize the existing business and to fulfill the Fiduciary’s objectives.
  • Compliance with internal processes in order to make business opportunities more efficient

Qualification & Experience:

  • Certified lawyer with 10 years of experience
  • Graduated in Law
  • Work experience in Trust areas desirable
  • Law master’s degree desirable.
  • Knowledge in Civil, Commercial, Corporate and Banking Law, and in regulation of Financial Institutions.
  • English and Spanish advanced level
  • Team management, work under pressure, decision making and conflict resolution.
  • Strategic vision and leadership
