The Legal Officer for Collections Activities will manage and oversee the legal aspects of debt recovery and collections processes, ensuring compliance with applicable laws and regulations in Mexico. This role involves providing legal advice, managing disputes related to collections, and supporting the organization in recovering outstanding debts while maintaining ethical standards.
Key Responsibilities:
1. Legal Support for Collections:
- Provide legal advice on collections strategies, ensuring adherence to relevant laws and regulations.
- Review and approve demand letters, notices, and other legal communications sent to debtors.
2. Debt Recovery Management:
- Handle pre-legal & legal actions related to delinquent accounts, including preparing and filing legal documents for recovery.
- Liaise with external legal counsel for litigation or enforcement proceedings.
- Represent the organization in court proceedings, negotiations, and mediations related to collections.
3. Compliance and Risk Mitigation:
- Ensure the organization’s collections activities comply with debt recovery laws, such as consumer protection regulations, fair debt collection practices, and data privacy laws.
- Monitor and address risks associated with collections, proposing strategies to mitigate them.
4. Negotiation and Settlement:
- Facilitate settlements with debtors, drafting and reviewing settlement agreements.
- Mediate disputes between the organization and debtors to resolve matters amicably where possible.
5. Documentation and Reporting:
- Maintain accurate records of collections cases, legal correspondence, and court proceedings.
- Prepare periodic reports on collections activities, highlighting progress and legal challenges.
Skills and Qualifications:
- Bachelor’s degree in law with credentials (“Título y Cédula”)
- Professional qualifications or additional training in debt recovery or collections law is an advantage.
- 3-5 years of experience in legal roles, particularly in debt recovery, banking, or financial services.
- Strong knowledge of collections laws and regulations in Mexico (REDECO, CNBV, PROFECO, etc)
- Excellent drafting, negotiation, and litigation skills.
- Availability to travel nationwide.
