Ensures execution and continuity of all BU’s marketing initiatives and product positioning (advertising, promotions, raffles, innovations, product development, digital platforms) by providing counseling to marketing, sales, regulatory, R&D and product groups, as well as support for the company’s advertising agencies in the development of plans; by setting strategies, preventive actions to ensure legal compliance and pursuing permits from administrative authorities and certification agencies, allowing the company to achieve business goalsControl contingencies derived from administrative proceedings before Ministries of Interior and Economy; Sanitary and Consumer Agencies, given relationships with consumers, product related complaints, sanitary verifications and new regulations that impact commercial activities for the business.Will provide strategic legal support in Data Privacy matters for PEP Mexico.This function will support LAB Mexico business in counseling on related matters to the objective set above**Your Impact****Marketing and product law.**:- Lead Marketing law team in providing advice on marketing, advertising, offers, and promotions, including marketing communications, consumer and B2B advertising, promotions, marketing/client presentations, digital creative, to prevent contingencies with consumers, administrative agencies and allowing commercial continuity.- Handle and set legal strategy and parameter under which promotions and activations will be executed.- Manage risk analysis for activations, promotions, and innovations.- Counseling to regulatory affairs, R&D, Food Safety, Quality control, and product groups in sanitary matters, claims constructions and certifications for products, and regulatory incidences (labeling).- Develop legal strategies in pursuing governmental approvals for advertising, promotions, and commercial initiatives.- Engage with authorities to ensure compliance of advertising and product related regulation, while avoiding impacts to commercial continuity.- Minimize any promotional negative implication by anticipating and clearing contingencies.- Counsel Operations, Quality Control, Sales, and product teams with sanitary and consumer agencies inquiries.- Key role in interpreting the law to assess impacts to the business and set compliance parameters.- Administer the correct training agenda in Marketing Law and Data Protection matters to employees (Marketing BU’s, promotions, product teams, HR, IT) to enhance the compliance of applicable regulations and internal policies.**Commercial litigation.**- Defend PepsiCo’s from contingencies derived from consumers’ claims, product related issues (food safety, quality, misleading claims) and class actions from consumers, defining legal strategies to defend the Company’s interests in proceedings before administrative authorities (PROFECO, COFEPRIS, INAI, Ministry of Economy and of Interior) that threaten commercial continuity.- Challenge new regulations to pursue injunctions and minimize impacts to business.- Lead and coordinate legal and administrative actions with outside counsel, direct reports, marketing, promotions, and product teams to defend the company’s commercial plans and ensure investments (~US $175MM) can be fully surrender in campaigns.**Data Privacy.**- Lead Data Privacy function by ensuring compliance of data protection regulation in PepsiCo Mexico’s projects with regards to consumers, employees, and providers information.- Manage, support, and advise on personal databases and treatment systems identification and privacy notices control.- Design of mechanisms for compliance with the obligations of the Privacy Officer and / or Personal Data Department.- Deploy staff training and awareness.- Ensure compliance of policies and guidelines for the protection of personal data.**LAB Support.*
