As a Global Marketing and Commercial Law Director for Pepsico Mexico, you will play a critical role in ensuring the company's marketing initiatives and product positioning comply with regulatory requirements and minimize risks. Your expertise will be essential in providing strategic legal support for marketing, sales, regulatory, R&D, and product groups, as well as supporting the company's advertising agencies in developing plans.
The ideal candidate will have a strong background in marketing law, consumer affairs, and commercial litigation, with experience in navigating complex regulatory environments. You will be responsible for setting strategies, preventive actions, and pursuing permits from administrative authorities and certification agencies to ensure business goals are achieved.
In this role, you will also provide counsel on data privacy matters for Pepsico Mexico, ensuring compliance with data protection regulations and managing personal databases and treatment systems identification and privacy notices control. Additionally, you will lead the Data Privacy function and deploy staff training and awareness programs to maintain compliance with policies and guidelines for the protection of personal data.

Your Impact
Marketing and Product Law:
You will be responsible for leading the marketing law team in providing advice on marketing, advertising, offers, and promotions, including marketing communications, consumer and B2B advertising, promotions, marketing/client presentations, digital creative, to prevent contingencies with consumers, administrative agencies, and allowing commercial continuity. This includes handling and setting legal strategy and parameters under which promotions and activations will be executed, managing risk analysis for activations, promotions, and innovations, counseling regulatory affairs, R&D, food safety, quality control, and product groups in sanitary matters, claims constructions, and certifications for products, and regulatory incidents (labeling).
You will develop legal strategies in pursuing governmental approvals for advertising, promotions, and commercial initiatives, engage with authorities to ensure compliance of advertising and product-related regulation, while avoiding impacts to commercial continuity, minimize any promotional negative implication by anticipating and clearing contingencies, counsel operations, quality control, sales, and product teams with sanitary and consumer agencies inquiries, key role in interpreting the law to assess impacts to the business and set compliance parameters, and administer the correct training agenda in marketing law and data protection matters to employees (marketing BU's, promotions, product teams, HR, IT) to enhance the compliance of applicable regulations and internal policies.
Commercial Litigation:
You will defend Pepsico's interests from contingencies derived from consumers' claims, product-related issues (food safety, quality, misleading claims) and class actions from consumers, defining legal strategies to defend the Company's interests in proceedings before administrative authorities (PROFECO, COFEPRIS, INAI, Ministry of Economy and of Interior) that threaten commercial continuity. You will challenge new regulations to pursue injunctions and minimize impacts to business, lead and coordinate legal and administrative actions with outside counsel, direct reports, marketing, promotions, and product teams to defend the company's commercial plans and ensure investments (~US $175MM) can be fully surrendered in campaigns.
Data Privacy:
You will lead the data privacy function by ensuring compliance of data protection regulation in Pepsico Mexico's projects with regards to consumers, employees, and providers' information, manage, support, and advise on personal databases and treatment systems identification and privacy notices control, design mechanisms for compliance with the obligations of the Privacy Officer and/or Personal Data Department, deploy staff training and awareness, and ensure compliance of policies and guidelines for the protection of personal data.
